Changes to Gift Cards Expiry

NSW Gift Card Expiry Update for 31 March 2018

The NSW government has announced that all gift cards sold in NSW from 31 March 2018 will now need to have a 3 year expiry date.

This will mean that the expiry dates for all Coles Group & Myer and our individual Coles Group branded gift cards sold after 31 March 2018 will go from 2 years to 4 years nationally.

We have made the decision to move to 4 years expiry to allow businesses who purchase our gift cards and on-sell them to consumers in NSW, have enough time to manage their stock on hand so they can meet their legal obligations.

  1. What is your new gift card expiry?

Gift Cards sold from 31 March 2018 will have a new 4 year expiry date.
The NSW Government has introduced a mandatory minimum expiry period of 3 years for gift cards. We anticipate other states to align with the NSW reforms overtime.

  2. Is the new Gift card expiry for NSW Gift Cards or for all Gift Cards nationally?

All our Gift Cards sold from Coles Group Corporate Services will have a 4 year expiry.

  3. What gift cards are exempt from these reforms?

Some gift cards are exempt from the reforms so these may not impact your business. If your company uses gift cards for any of these purposes, you are exempt from complying with this legislation. Please seek your own legal advice to confirm if your business is exempt from the legislation. For more information refer to Fair Trading Amendment (Ticket Scalping and Gift Cards) Act 2017.

  4. If you are an onseller of Coles Group gift cards, what happens with the stock you already have on hand before and after 31 March 2018?

    • Before 31 March 2018 – all states INCLUDING NSW:
You can still sell these cards to all customers in all states.
    • After 31 March 2018 – all states EXCLUDING NSW:
You can still sell these cards to other customers in other states ie VIC, QLD, SA, WA, NT & TAS. Gift cards sold to consumers who provide an address outside NSW are not required to carry a 3 year expiry date, so all existing stock on hand can be allocated to these customers.
    • IN NSW after 31 March 2018:
You cannot sell these cards to customers in NSW. Please contact Corporate Services for further assistance.
  5. What if you onsell Coles Group gift Cards to NSW customers, what do you need to do?

It will be important to manage your stock on hand between now and 31 March 2018. There will be penalties for non-compliance. NSW Fair Trading has published a Statement of Regulatory Intent that sets out their approach to compliance and enforcement during the transition period.
